TERMS AND CONDITIONS FOR USE OF DOTT’S APP AND DOTT’S VEHICLE SERVICES IN BELGIUM

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AS THEY GOVERN YOUR USE OF THE SERVICES (AS DESCRIBED BELOW) PROVIDED BY DOTT IN BELGIUM

These terms and conditions (“ Terms”) govern your (hereinafter “ you” or “ your”) (i) use of our mobile application (“ App”) following your registration for a User Account (if applicable), and (ii) rental of our shared electric bikes (“ e-bikes”) and shared electric scooters (“ e-scooters”) (collectively “ Vehicle(s)”) provided by emTransit SRL, with registered office at Rue Plantin 17 1070 Anderlecht (“ Dott”, “ we”, “ our” or “ us”) via the App or via a third party platform authorised by Dott from time to time in Belgium (collectively “ Services”). Subject to these Terms, you and Dott enter into a contract for the usage of the App, including the User Account if applicable, (“ App Agreement“) and into separate contracts for each use of a Vehicle (“ Individual Rental Agreements”) relating to your usage of our Services in Belgium.

If you rent a Vehicle through a Third Party Platform, all of these Terms shall apply to your use of our Services except for sections 1, 2 and 6 below. You will also be subject to the Third Party Platform’s terms and conditions in addition and without prejudice to these Terms.

DURING THE REGISTRATION PROCESS FOR OUR APP, WHEN USING THE APP AND WHEN UNLOCKING A VEHICLE FOR USE VIA THE APP OR VIA A THIRD PARTY PLATFORM YOU MUST AGREE TO THESE TERMS. DOTT ONLY ALLOWS YOU TO USE THE SERVICES IF YOU ACCEPT THESE TERMS AS DISPLAYED IN THEIR LATEST VERSION ON THE APP. DO NOT MAKE USE OF THE SERVICES IF YOU DO NOT AGREE TO THESE TERMS.

These Terms refer to the following additional terms, which also apply to your use of some or all Services:

• Our privacy policy is available at: Privacy Policy (“ Privacy Policy”). In order to provide the Services to you, we may need to collect and use your personal information.
• The main terms of our insurance policies are available at: Insurance Policies (“ Insurance Policies”), which set out the extent of insurance coverage you may receive when using our Vehicles.

If you use the Services while in a country other than Belgium, the Services are offered by an affiliate of Dott located in such other country. In this case, you will enter into an App Agreement (if applicable) and into the Individual Rental Agreements with such local affiliates of Dott based on the country-specific Terms and Conditions available here.

TERMS APPLICABLE TO YOUR USE OF THE SERVICES

You must be at least 18 years of age and have the requisite mental and legal capacity to use our Services.

1. YOUR USER ACCOUNT
   You must register for a user account through the App (“ User Account”). A User Account must be created via the App. In order to set up your User Account the App will prompt you to provide us with (i) certain information about yourself, (ii) a method of payment, and (iii) any other information or documents required.

Your User Account is strictly personal to you and you will ensure that it is kept secure and not shared with or used by anyone else. You must immediately report any suspicions of unauthorized access to your User Account to: support@ridedott.com.

Each use of a Vehicle unlocked via your User Account shall be deemed a strictly personal, individual and exclusive use by You.

2. USE OF THE APP
   The unlocking and the use of the Vehicles requires the use of the App with your User Account. The App can also not be used to commit any criminal activity online, or to infringe the privacy or other rights of others.

3. USE OF VEHICLES
   Via your User Account you can rent a Vehicle based on an Individual Rental Agreement. When you unlock the Vehicle in your User Account, you enter into an Individual Rental Agreement with Dott for the use of such specific Vehicle. The ride starts from the moment you “unlock” a Vehicle in the App and ends as soon as you select the “end ride” option.

Age and Capacity: You are at least 18 years old and familiar with the way of operating our Vehicles.

Safety First: You should inspect the Vehicle for damage and check your surroundings before riding. Dott is not liable for any injuries which could have been avoided by safety measures including helmet use.

Parking: You must park Vehicles in Designated Parking Areas within the Operational Areas and in accordance with local regulations.

Fines: You will be solely liable for and will pay any fines, fees, penalties, or costs imposed by authorities resulting from improper use of a Vehicle.

Reporting Accidents and Loss or Damage to Vehicles: You must report any damages, accidents, personal injuries, or losses immediately.

RISK OF INJURIES AND DAMAGES: Riding, using, or operating a Vehicle carries an inherent risk of causing injury or damage.

4. INSURANCE
We will maintain the insurance required to operate our Services under local laws, such as third-party liability insurance.

5. FEES, CHARGES AND PAYMENT

Fees: The fees for the use of our Vehicles are charged on a pay-per-use basis. Each time you wish to use a Vehicle, you may be charged an unlock fee in addition to use fees.

Payment: Payment may be made by the credit or debit card you loaded in order to register for a User Account.

6. INTELLECTUAL PROPERTY
You are granted a limited license to download and use our App solely for personal use.

7. LIMITATION OF LIABILITY
DOTT’S LIABILITY FOR DAMAGES CAUSED BY SLIGHT NEGLIGENCE SHALL BE LIMITED.

8. INDEMNIFICATION
You agree to indemnify, defend and hold harmless Dott from all claims arising from your misuse of the Services.

9. TERMINATION
Both parties have the right to terminate the App Agreement at any time subject to a prior notice to the other party.

10. MODIFICATIONS
We may amend these Terms from time to time.

11. FORCE MAJEURE
We shall not be responsible for any loss, damage, default or failure caused by occurrences outside of our control.

12. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of Belgium.

13. GENERAL
If any provision of these Terms is found to be invalid or unenforceable, the remainder will continue to be valid.

GROUP RIDES TERMS
In some cities, we offer the option to simultaneously rent multiple Vehicles through your User Account and allow others to use them together in a Group Ride. The terms outlined apply to Group Rides and are supplemental to the terms for use of Dott’s app and vehicle services in Belgium.

1. AVAILABILITY Group Rides are subject to availability.

2. HOST’S RESPONSIBILITIES You are solely responsible for inspecting all Vehicles before use and ensuring that all safety measures are properly communicated.

3. LIABILITY AND COSTS You are responsible for all costs related to a Group Rider’s use of the Services, including damages to Vehicles.

4. INDEMNIFICATION You agree to indemnify Dott for any misuse of the Services.

5. REPORTING ACCIDENTS AND DAMAGES You must report any damages or accidents in the context of a Group Ride immediately.
